User Agreement
By downloading, installing, and using the PassSnapAI application on your iOS device, you agree to be bound by these Terms of Use and our Privacy Policy. This Agreement constitutes a legal contract between you and the developer of PassSnapAI governing your use of the App. If you do not agree to all the terms and conditions set forth in this Agreement, you must immediately cease downloading, installing, and using the App. The App is intended for use by general users, and by using the App, you confirm that you comply with all applicable local laws and regulations.
All information is processed locally, all information is only stored on the local user device, and information will be deleted when the user actively deletes it, so the App does not collect any facial data.
The Developer grants you a non-exclusive, non-transferable, revocable license to use the App solely for personal, non-commercial purposes in accordance with this Agreement. You may use the App to generate standard ID photos for your own personal use, such as for passports, driver’s licenses, visas, and other official documents that require compliant ID photos. You agree not to use the App for any commercial purposes, including but not limited to generating ID photos for third parties in exchange for payment, or using the App’s output in any commercial product or service without the Developer’s prior written consent. All operation and data processing procedures of the App are completed locally on your device, and no facial data will be generated or transmitted outside your personal device.
You shall not misuse the App in any way that violates applicable laws, regulations, or this Agreement. Prohibited uses include, but are not limited to uploading or processing images that contain illegal content, copyrighted material without proper authorization, or images that infringe on the privacy or intellectual property rights of third parties, modifying, reverse-engineering, decompiling, disassembling, or attempting to extract the source code of the App or its underlying local AI technology, using the App to generate fraudulent or misleading ID photos for illegal activities, interfering with or disrupting the operation of the App, and sharing the App with others in a way that violates this license or circumvents any usage restrictions. All image processing work is completed locally on user devices with no external data interaction.
You are solely responsible for all images you upload, capture, or process using the App collectively User Content. You represent and warrant that you have all necessary rights, permissions, and consents to use and process such User Content, and that the use of such User Content in connection with the App does not violate any applicable laws, regulations, or the rights of any third party including but not limited to privacy rights, copyrights, trademarks, and publicity rights. The Developer shall not be liable for any claims, damages, or losses arising from your use of unauthorized or infringing User Content, and you agree to indemnify and hold harmless the Developer from any such claims.
All User Content processing is completed on your local device, and all related content only exists on your personal device. You can delete all relevant information at any time through active operation, and the App will not retain any of your content or facial data. You acknowledge and agree that the Developer has no control over how you use the generated ID photos, and you are solely responsible for ensuring that the generated ID photos comply with the requirements of the relevant issuing authority such as government agencies, embassies for which they are intended. The App is designed to generate ID photos that meet common size and format standards, but the Developer does not guarantee that the generated photos will be accepted by all authorities, as requirements may vary.
The App uses local AI technology to generate ID photos based on the User Content and the settings selected by you such as size, background color, cropping rules. All local AI calculation and content generation processes are finished locally on user devices without any external data transmission. The Developer strives to ensure that the local AI-generated output meets common ID photo standards, but makes no warranties or representations regarding the accuracy, quality, suitability, or acceptability of the generated photos. The local AI-generated photos are provided as is without any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. The Developer shall not be liable for any damages or losses resulting from the rejection of local AI-generated photos by any authority, or from any errors, omissions, or defects in the generated output. The whole generation process does not involve any collection of facial data by the App.
All intellectual property rights in and to the App, including but not limited to the software, code, algorithms, local AI technology, trademarks, logos, and user interface elements, are owned by the Developer or its licensors. This Agreement does not transfer any intellectual property rights from the Developer to you, and you shall not acquire any ownership rights in the App or its components through your use. You may not use any of the Developer’s intellectual property without prior written authorization.
The local AI-generated ID photos are considered User Content, and you retain all rights to the generated photos for your personal use. All data generated during the local AI creation process is stored only on your local device, and no relevant data will be reserved or utilized by the Developer.
To the maximum extent permitted by applicable law, the Developer shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with your use of or inability to use the App. This limitation applies regardless of whether the Developer has been advised of the possibility of such damages, and applies to all claims arising from this Agreement, including but not limited to breach of contract, tort, negligence, and strict liability.
The Developer’s total liability to you for any claims arising from this Agreement shall not exceed the amount you paid to download the App. If the App was downloaded for free, the Developer’s liability shall be limited to nominal damages.
This Agreement shall remain in effect until terminated by either party. The Developer may terminate this Agreement and your license to use the App at any time, without prior notice, if you violate any term or condition of this Agreement. Upon termination, you must immediately cease using the App, uninstall it from your device, and delete any copies of the App in your possession. Sections of this Agreement that by their nature should survive termination including but not limited to intellectual property rights, limitation of liability, indemnification, and disclaimer of warranties shall continue to be binding on you after termination. All local data related to the App will be completely removed upon your uninstallation operation.
The Developer reserves the right to modify or update this Agreement from time to time. Any changes to the Agreement will be posted within the App, and the updated Agreement will take effect immediately upon posting. Your continued use of the App after the posting of the updated Agreement constitutes your acceptance of the modified terms. The Developer encourages you to review this Agreement periodically to stay informed of any changes.
This Agreement shall be governed by and construed in accordance with local applicable laws, without regard to its conflict of laws principles. Any disputes arising out of or in connection with this Agreement shall be resolved through negotiation in good faith. If negotiation fails, the dispute shall be submitted to the exclusive jurisdiction of the local competent courts.
If any provision of this Agreement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The failure of the Developer to enforce any term of this Agreement shall not constitute a waiver of that term or any other term of the Agreement.
